TERMS OF SERVICE

Terms of Service updated as of 29/04/2022

By commissioning me, you are agreeing to the terms of service below.

 â˜…THINGS TO KNOW BEFORE COMMISSIONING ME★ 
Read before requesting

STRICT RULES 
Nonnegotiable 

  • Do not use any of these pieces of artwork for any sort of NFT purposes otherwise you will be blacklisted.  

  • Please avoid rushing the delivery of your commission, if you need it by a deadline make me aware BEFORE you have paid for your commission as there will be a priority charge.  Please keep in mind, regardless of priority, i am only one person and will need to take my time on your commission, due to health reasons i cannot and will not rush your commission. If your simply wanting an update, feel free to check where you are in my QUEUE or ask me.

  • Payment is made only by Paypal in USD and must be made in full before starting your commission. Your welcome to request a Payment plan if your commission is priced above 100USD.

  • You have the right to publish, use and promote your commissioned artwork wherever you wish as long as proper credit is given to the artist (me) and is not monetized (monetized publishing must be discussed with me). To credit me, please provide a link to any of my socials OR @ me if its on social media. 

  • Any ill or unkind behavior will not be tolerated and your commission will be canceled if it occurs.

Specifics of terms of service that vary due to commission type

ILLUSTRATION

  • An illustration can be made without a clear reference sheet for the character but in turn you must give a very detailed description of the character in question and will be charged an additional character design fee. Reference images or mood boards are also appreciated. 

  • Larger complexity illustrations ,such as models or any illustration with a background take more time and will therefore be placed at the back of my queue if i have more than one client at a time. (This may be waved but a priority fee will be added)

  • My specialty is in anime style characters, you may ask for commissions in another style however i have the right to refuse your commission if i feel i cannot accurately portray what your asking of me.


MODEL ART 

  • Provide an existing and clear character/design sheet of your model. I will not accept mood boards as reference UNLESS your wanting me to design your character for you, in which there will be a additional character design charge.

  • Average canvas size with usually be around 6000-7000 px, Maximum canvas size can be 7000-8000 px in height when specified.

  • The model will be drawn part-by-part instead of finishing the model's art, cutting the parts, and painting over. This makes parts easier to adjust/revise! In some cases, this may make your png look ever so slightly different to your finished rigged model, especially if it contains complex parts. 

  • If you want your model in a specific style or aesthetic please make me aware ahead of time. Examples will be very much appreciated. i WILL NOT however copy another artists style. 
     

RIGGING 

  • You must have the .psd file ready. Layers or parts must be properly named and separated.

  • If i find parts of the model that still need to be separated, or i deem them necessary to be separated for better movement, i will separate them myself (note; i will never make any changes to the actual appearance of the art in doing this), if there are MANY that need to still be separated, i will have to issue an additional charge OR have the .psd sent back to the original artist for revisions.

  • If the model has a lot of specific features to be added, kindly provide a Google Docs, PDF file or long detailed message with proper description of features you want added as well as reference images for expressions and/or videos for animation-related features. This is to lessen the back and forth communication between client and rigger, resulting in a more efficient workflow for the rigger. (NOTE; if i feel something your wanting in your model is outside mine or Live2D's realm of capabilities i will tell you, if you argue with me on these I will refuse your commission)

  • Model (especially the face) must be at the very center of the canvas, facing the front. Facial parts should be symmetrical as much as possible. (I may rig other angles of models but ONLY if i have illustrated the art myself, so you'll need to commission both art and rigging for unique model angles) 

  • I will not accept model files exceeding 8000 by 8000 px. My current PC cannot handle the workload when rigging really high resolution models. if your model file is above this size, ill require either you or your model artist to resize it.

  • Adding additional features during the rigging process will count as a re-rigging depending on complexity and may require further fee's. 

     

★ARTIST AND COMMISSIONER RIGHTS★ 
The rights that you and i maintain throughout and AFTER the commission process.

AS THE ARTIST I... ​

  • Maintain the right to stream commissions on my Twitch/Youtube channel. (This right may be waved, however client will be required to pay an additional privacy fee to compensate for lack of exposure)

  • Maintain the right to post commissions to my social media for advertising and portfolio purposes, with respective credits to the client and/or artists involved. (This right may be waved, however client will be required to pay an additional privacy fee to compensate for lack of exposure)

  • Have the right to turn down any commission. You have no right to go against me regarding this matter.

  • Will not be held responsible for any misconception if the commissioner did not read my Terms of Service thoroughly.

  • Have the right to turn down commissions forcing me to apply a style i feel i cannot accurately portray or copy another artist's art style.


AS THE COMMISSIONER YOU... 

  • May make monetized content using your commission to your preferred media platform IF commercial rights are included in your chosen commission type. (if not included, commercial fees may be added to a normally non commercial commission type upon discussion with me)

  • Should ALWAYS credit me as the Artist or Rigger depending on the commission type. If you will be continuously using your commission (E.G. streaming with a model, or using your com as a banner/profile picture) i will also require credit in a bio/about section.

  • Should ALWAYS credit your respective artist/designer who made your model art if you've only commissioned me for the rigging.

  • May request small revisions like color changes to finished pieces or changing the intensity of physics in a rig. Large revisions and redraws must be paid for.

  • Are NOT allowed to redistribute the model file or artwork UNLESS given specific permission.

  • Are NOT allowed to reuse the parts for personal or commercial use UNLESS given specific permission.​

     

★COMMISSION CANCELATION AND REFUND POLICY★ 
Should you or i want to cancel the commission...
 

  • I have the right to cancel your commission at any time. If i have yet to begin your commission, your money will be fully refunded. if i have begun work, you will not receive a full refund and instead a partial refund will be issued. (Unless reason for cancelation is you committing a breach of TOS in which you will receive no refund at all) 

  • If you file a chargeback against me or use your commission for any blockchain/NFT/crypto purposes (which is specifically against my TOS), your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers. I will also be publicly warning my fellow artists about you.
